Welcome to The Cat Pharmacy, a resource dedicated to providing essential prescription medicines for cats at not-for-profit prices.

If you chose to use this website and the services of The Cat Pharmacy it will be assumed that you have read and understood the content of this section which contains the legal, binding conditions governing your use of our services and products. By accessing or using the site, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you must not use our website.

1. General Information

1.1 Company Information: The Cat Pharmacy is a not-for-profit organisation, it is not a charity; we do not fundraise and so have no ability to provide free medicines. The Cat Pharmacy is a Trading Name of The Microsampling Laboratory Ltd. (MSL) which is a Private Limited Company, number 11590705 registered in England & Wales, with its registered office at Cygnus House, 9 Plough Close, Shillingford, Wallingford, Oxfordshire. OX10 7EX UK. MSL is also a not-for-profit organisation, dedicated to studying cat diseases and supporting veterinary surgeons treating them. At present MSL is studying the treatment of Feline Infectious Peritonitis (FIP) using the anti-viral drugs GS-441524 and EIDD-1931. 

1.2 Eligibility to Use the Site: In the UK, pet owners collecting or using a written veterinary prescription to obtain medication, whether from a pharmacy, online retailer, or another veterinary surgeon, must be over 18 years of age. By accessing or using our site, you are affirming that you are at least 18 years of age, and also that you have the capacity to agree to these Terms. 

2. Products and Services

2.1 Prescription medicines for Pets: We offer to supply medicines on prescription (classified in the UK as POM-V, POM-VPS, extemporaneously prepared products (Specials) and human medicines) which are intended for animal use.

2.2 Prescription Products: These medicines can only be supplied by us on the instructions of the veterinary surgeon providing the treatment and care of your cat. This is done by them giving you a prescription which you send to us. On receipt of the original prescription i.e. not a copy, scan or other image, we will verify the vet's instructions, call you to check that the information on the prescription is accurate (this also acts as a security validation) and, if all is as it should be, we will take payment by credit/debit card and post the medicine/s to you by first class post. We are legally obliged to do this, and we reserve the right to decline your order if we cannot authenticate the prescription or if it is not suitable for your cat for any reason. In such circumstances we will contact the veterinary surgeon named on the prescription for clarification.

2.3 Availability: We make every effort to ensure that medicines will be in stock so we can supply them on demand, however it may be that a product is out of stock. Whilst we will make every effort to supply what the prescription requires, it may be that delays will occur. We will contact you immediately if any such issues arise to discuss alternatives, making the welfare of your pet the priority.

3. Orders and Payment

3.1 Placing an Order: When you place an order through our website, you are making an offer to purchase products subject to these Terms and conditions. All orders are subject to our acceptance. We reserve the right to reject or cancel any order at our discretion, including but not limited to, situations involving suspected fraudulent activity, unavailable stock, or issues with your payment method.

3.2 Payment Terms: Orders will be prepared for shipping immediately on receipt of a valid prescription, but will not be posted until payment in full has been received. We accept payment by credit or debit cards, taken over the phone when we contact you to validate the order. Credit card details are not stored under any circumstances. You agree to provide accurate and complete payment information at the time of purchase.

3.3 Order Confirmation: As soon as we receive the prescription we will send you a confirmation email with details of the order and the total price. If you do not wish to continue with the order you must inform us immediately, at which point we will return your prescription by second class post. Once your order is posted we will send you a confirmation email. A VAT receipt (suitable for presenting to insurance companies as part of a claim) and credit card receipt will be included in the medicine package. 

3.4 Pricing and Taxes: Medicine prices to us are subject to change without notice. We will endeavour to provide the lowest price for each medicine, so if the cost to us of that medicine decreases, the price to you will also decrease; obviously the opposite may occur. We cannot avoid having to charge VAT at the current rate, so this is added to the basic price and shown on your receipt.

4. Shipping and Delivery

4.1 Shipping Policies: We will do our best to deliver products rapidly; primarily by first class Royal Mail or, (if any can be found that are faster &/or more reliable), other courier companies. As always, we cannot be held responsible for delays caused by third-party faults or unforeseen circumstances.

4.2 Shipping Costs: Shipping costs will be calculated individually for each order and the cost of post & packing included in the price we quote. As we aim to not make a profit, free postage is not offered; we may also recycle packaging to reduce both cost and landfill waste.

4.3 Risk of Loss: All items purchased from the website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon delivery to the carrier.

5. Returns and Refunds

5.1 Return Policy: Due to the nature of the products, we cannot accept returns of pharmaceutical or prescription items unless they are defective, damaged in transit, or incorrectly shipped. Fridge items cannot be returned under any circumstances.

5.2 Refunds: If you are eligible for a refund, we will process the return and issue a refund to the original payment method. Shipping charges are non-refundable unless the return is due to an error on our part.

6 Privacy Policy & data protection: 

6.1 We take your privacy seriously. This section describes how we collect, use, and protect your personal information when you use The Cat Pharmacy. As the prescription process involves a physical piece of paper (the prescription signed by your vet) you do not need to log in to this website or enter any personal information. The website is simply to inform you that The Cat Pharmacy exists and that it works using some rules (these Terms & Conditions). Your prescription is used by us to create an entry in a data base which is held at the pharmacy and only accessed by me, Stephen Cooke, whilst checking and dispensing your medicnes. A removable hard drive holding the data base (it is not held in 'the cloud') is stored in a secure safe when not in use. Any paperwork generated by the process is scanned into the data base after being certified as valid, then the paperwork is shredded and incinerated. The pharmacy computer is not connected to the internet, so is not vulnerable to external hackers or sources of malware. The Company is registered with the Information Commissioner's Office IOC:00013432898 

Personal data will be processed lawfully, fairly, and transparently in accordance with applicable data protection legislation, including the UK GDPR. The Cat Pharmacy will not sell personal data or share it with third parties under any circumstances.

6.2 User Conduct: You agree to use the website and services in compliance with all applicable laws and regulations. You must not use the site for any unlawful or harmful activities, including, but not limited to, fraud, the transmission of harmful viruses, or the unauthorized access to our systems.

6.3 Veterinary involvement: You acknowledge that any information provided by us, for instance when we validate your prescription over the phone, does not constitute a veterinary consultation or advice. Always consult your own veterinary surgeon before making decisions about your pet's health, including the use of any pharmaceutical or prescription products.

7. Intellectual Property

7.1 Copyright and Trademarks: All content on the website, including but not limited to text, images, logos, product descriptions, and software, is the property of The Cat Pharmacy or its licensors and is protected by intellectual property laws. You may not use any content from the site without express permission.

8. Disclaimers and Limitation of Liability

8.1 Disclaimers: We make no representations or warranties about the accuracy or reliability of the content on the website or the products sold. All products are provided "as is," and we disclaim any warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

8.2 Limitation of Liability: To the fullest extent permitted by law, The Cat Pharmacy will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the website or purchase of medicines.

9. Changes to Terms and Conditions

We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the website, and your continued use of the website constitutes acceptance of those changes.

10. Governing Law and Dispute Resolution

10.1 Governing Law: These Terms will be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

10.2 Dispute Resolution: In the event of a dispute, we encourage you to contact us to resolve the issue amicably.
